What is a tax foreclosure?

A tax foreclosure is initiated by the County, County hospital, or school district in order to collect on property taxes against a property. Every year, Texans pay a percentage of their home’s value that the school district, County hospital, and County rely upon in order to budget and pay for infrastructure, salaries, etc. So, naturally, these entities are extremely reliant upon you and your neighbors to pay their property taxes every year.

What happens if I don’t pay my property taxes?

Generally, if you miss payment on your property taxes, you will be penalized for failure to pay. This penalty is statutory and promulgated by the Texas legislature. For the most part, there is very little you can do to get rid of this penalty. The same is true if the County hires attorneys to initiate a tax foreclosure – these expenses will be passed along to you.

What happens if I am foreclosed upon?

If you suffer the loss of your property through a tax foreclosure, you have the right to redeem the property within two years. In the first year, you have to pay back the buyer what they purchased the property for plus an additional 50% whereas in the second year you need to pay back double what was paid for the property.

The path to redeem your property is an expensive one and may not be worth the risk. Additionally, there is little you can do to overturn a tax foreclosure outside of notice requirements.
